Charge Dismissed!

I could leave it at that, but I shall not. It turns out that the specific accusation, which we didn’t know before today, was that I stopped her in the hallway and told her “one of these days I’m going to get you in my apartment and have sex with you.”

Seriously, with something that looks like this?

There was also mention that I was constantly in the hallway and on the balcony whenever she was. And apparently what I supposedly said to her hurt her, scared her, and struck a nerve because she’s had similar encounters in the past (which she then admitted she never filed charges over, and as such is likely as untrue as everything else she said).

After her testimony, and determining that her witness was irrelevant as he wasn’t present when the alleged exchange had occured, my attorney made a motion to dismiss, which the judge immediately granted after a long diatribe as to why he was doing so. That being, that as it was only a one time thing, that doesn’t constitute harassment, and as I had no way of knowing what may or may not have happened in her past, I couldn’t have intentionally opened any old wounds by saying what I supposedly said.

So after all that, and having to spend several hundred dollars on a lawyer to defend me, even if I had done it, it wouldn’t have mattered. Probably the most amusing part was when the judge asked me “can you understand why saying that would have struck a nerve?” I was going to start answering by saying I never said that, but before I could hardly even start a word out of my mouth, my lawyer threw his hand in front of me and said “just say yes!” Well, that and afterwards when my lawyer and the judge agreed that “she isn’t exactly a Madonna.” I think the judge knew she was lying through her teeth.

Now all I need to do is get this job tomorrow and I’ll be set. Whoopee!
